General provisions

  • These rules for the purchase and sale of Goods (hereinafter referred to as the Rules) are a binding legal document for the parties, which establishes the rights and obligations of the Buyer and Seller, the conditions for the purchase and payment of Goods, the procedure for the delivery and return of Goods, the liability of the parties and other provisions related with the sale and purchase of Goods in the online store www.officeday.lt.
  • The Buyer must read and accept these terms and conditions (tick the box next to “I agree to the terms. I am familiar with the right of return”).
  • If the Buyer does not agree with these rules, in this case, the purchase-sale transaction in the online store www.officeday.lt is not possible.
  • The Seller reserves the right at any time to amend, change or supplement the Terms, in accordance with the requirements of the law. The Buyers will be notified of any changes, modifications or additions registered at the online store www.officeday.lt and, in order to shop in this online store, will have to re-accept the amended Rules.
  • The online store www.officeday.lt is engaged in the trade in Lithuania.

The following persons have the right to buy in the online store www.officeday.lt

  • Capable natural persons.
  • Minors from the age of fourteen to eighteen, with the consent of their parents or guardians, except when they are independently disposing of their income.
  • Also authorized representatives of all the above mentioned persons.
  • Legal entities.
  • By accepting the Rules of www.officeday.lt, the Buyer confirms that he has the right to purchase the Goods at the online store www.officeday.lt.

Protection of personal data

  • The rules for the processing and protection of personal data provided for in these Rules apply to all personal data provided to the Seller by the Buyer or collected by the Seller and processed by the Buyer using the www.officeday.lt web site.
  • By registering on the online store www.officeday.lt in, Buyers must provide correct information and fill out additional information marked with asterisks. The Buyer is responsible for submitting the correct data.
  • The Seller respects the privacy of the Buyer and other visitors of the www.officeday.lt website and stores their personal data that are provided to the Seller and collected by the Seller, as specified in these Rules and the Privacy Policy, which explains why the Seller collects personal data and/how they use them.
  • The Buyer willing to order items from the online store www.officeday.lt must sign up on this website.
  • The Buyer, by registering in the online store www.officeday.lt, has to enter his e-mail address and password. By confirming these Rules, the Buyer confirms at the same time that he is informed that information notices which are required to complete the Goods order will be sent to e-mail address indicated by him.
  • The Buyer, having signed up the online store www.officeday.lt, in his profile provides the following personal data necessary to complete the order: first name, surname, phone number, e-mail address, postal address, address of the payee (delivery).
  • The Buyer confirms that he is aware of his right to refuse to provide his personal data specified above, but understands that these personal data are necessary for the execution of the order of the Goods, and if the Buyer fails to provide such data and refuses to process them for the purposes specified in the Privacy Policy, the contract for the sale of Goods may not be concluded and executed.
  • The Seller's Privacy Policy applies for any information relating to personal data that is registered in the online store www.officeday.lt (https://www.officeday.lt/information-klientui/privatumo-politika/). The Seller applies the safety and handling requirements set out in the General Data Protection Regulation of the European Union and in the Republic of Lithuania Law on the Legal Protection of Personal Data and other applicable legal acts, for the processing of data.
  • The Seller shall take appropriate technical and organizational measures to ensure the protection of all personal data processed against unintentional or unlawful destruction or accidental loss, modification, unauthorized disclosure or access, and against all other forms of unlawful processing.

Conclusion of purchase – sale agreement

  • The agreement between the Buyer and the Seller is considered to be concluded from the moment when the Buyer chooses the purchased item (s) and has formed a basket of Goods, clicking on the link “Order”.
  • Each purchase and sale agreement concluded between the Buyer and the Seller is registered and stored in the database of the online store officeday.lt.

Buyer‘s rights

  • The Buyer has the right to purchase the Goods in the online store www.officeday.lt in accordance with the procedure established by these Rules.
  • The Buyer has the right to refuse the purchase and sale agreement concluded with the online store www.officeday by notifying the Seller thereof in writing (by e-mail, indicating the intention return of the item and the order number) no later than within 14 (fourteen) business days from date of delivery of the Goods.
  • The Buyer's right to withdraw from the purchase and sale agreement is executed in accordance with the procedure established by the applicable legislation.

The Buyer can use the following rules for the exercising right of withdrawal:

  • At the request of the Buyer, without any good reason or in case of the wrong size, colour, etc. of the item, provided that the item has not been damaged or its appearance substantially altered, nor has it been used (unopened original labels and markings).
  • If the product (s) were defective or damaged during transportation to the Buyer.

Buyer’s obligations

  • The Buyer must pay for the Goods and accept them in accordance with the procedure established by these Rules.
  • The Buyer undertakes not to transfer to third parties their login data to the user account on the online store www.officeday.lt. If the Buyer loses his login information, he may contact the Seller in the means indicated in the Contacts section or click the Password Reminder link.
  • By using the online store www.officeday.lt, the Buyer undertakes to comply with these Rules, other terms, expressly stated in the online store, and not violate the laws and regulations of the Republic of Lithuania.
  • The Buyer is responsible for submitting the correct data to the online store officeday.lt.

Seller’s rights

  • If the Buyer attempts to affect the stability and security of the online store or breaches its obligations, the Seller has the right to immediately and without warning to restrict or stop him from accessing the Internet shop and/or to cancel the Customer's registration. Any attempts to undermine the stability of the online store are investigated and, if necessary, transmitted to law enforcement agencies.
  • In the event of material circumstances, the Seller may temporarily or completely terminate the operation of online store without notifying the Buyer.

Seller’s obligations

  • The Seller undertakes to provide the Buyer with the services provided by the online store www.officeday.lt at the conditions established by these Rules and the Internet shop.
  • The Seller undertakes to respect the Buyer's privacy right to the personal information contained in the online store registration form, except for the cases specified in the laws of the Republic of Lithuania, in which the criminal act related to the Buyer is committed and these data are necessary for law enforcement agencies.
  • The Seller undertakes to deliver the Goods ordered by the Buyer at the address indicated by him. The Buyer is responsible for the accuracy of the data submitted.
  • The Seller, due to certain circumstances, unable to deliver the Goods ordered to the Buyer, undertakes to offer an analogous item for replacement. If the Buyer refuses to accept the analogous item, the Seller undertakes to return the money paid to the Buyer within 5 (five) business days if prepayment has been made.

Prices of Goods, payment order and terms

  • The electronic catalog of Goods contains the retail prices in euro, VAT included.
  • Individuals pay for Goods through an online banking system.
  • Constant customers of Officeday, after signing a sales contract and signing up with their electronic office supply systems will see their own, contractually agreed price of the Goods. The term of payment is based on a sales contract.

Delivery of items

  • Goods are delivered on the territory of Lithuania. The Buyer chooses the most appropriate delivery method during the execution of the order, which determines the price and time of delivery. The exact delivery time depends on the chosen delivery method and ordered Goods.
  • Delivery of Goods is free, if the amount of the Buyer's purchases is no less than 55 € without VAT.
  • Delivery by courier service: When ordering Goods from Monday to Friday until 16:00, the Goods are delivered to the specified address on the next business day. If the amount of the shopping cart is less than the delivery price of 55 € without VAT, the delivered price shall be 5 € without VAT.
  • Delivery to Lithuanian Post Office: this delivery method is currently only applicable for natural persons. The Goods are delivered to the post office under the specified address within 5 days. A message shall be sent to the mail box, with which and with the identity document the customers can collect the item at the post office. If the amount of Goods is less than 55 € without VAT, the delivery price is 5 € without VAT.
  • The Buyer, when ordering the Goods, undertakes to indicate the exact delivery address of the Goods.
  • The Buyer undertakes to accept the Goods himself. In the event that he cannot accept the Goods himself, and the Goods are delivered at the indicated address and on the basis of other data provided by the Buyer, the Buyer is not entitled to express any claims to the Seller regarding the delivery of the Goods to the unfit entity.
  • The Buyer understands and agrees that, in exceptional cases, delivery of the Goods may be delayed due to unforeseen circumstances beyond Seller's control. In such a case, the Seller undertakes to immediately contact the Buyer and coordinate delivery of the items.
  • In all cases, the Seller is released from liability for violation of the recommendation terms of delivery of Goods, as well as if the Goods are not delivered to the Buyer or delivered in a timely manner due to the fault of the Buyer or due to circumstances determined by the Buyer.
  • At the time of delivery the Buyer must check the condition of the shipment with the Seller or his authorized representative. Upon signature by the Buyer on the invoice (consignment note) or in another transfer and acceptance document, the consignment is considered to be in a satisfactory condition. Having noticed that the package of the delivered item is damaged (wrinkled, wet or otherwise externally damaged), the Buyer must indicate this on the invoice (bill of lading) or in another transfer letter-acceptance document and, in the presence of the Seller or his representative, to draw up a report consignment damage in the free-form.
  • If the Buyer fails to do so, the Seller is exempted from liability to the Buyer for the damage of the Goods, if such damage was caused by packaging damage resulting from the transportation of the item (s) not specified by the Buyer in accordance with the above procedure.
  • In the event that the Buyer, on the basis of these Rules, withdraws from the contract of sale and purchase (if the Goods are not defective or damaged during transportation), he is liable for payment of all direct costs of returning the Goods to the Seller.

Product quality guarantee

  • The properties of each brand sold at www.officeday.com are collectively referred to in the product description for each item
  • All products are covered by a warranty for the duration of that by its manufacturers.
  • The products bearing the manufacturer's warranty are sold by issuing a warranty card containing the warranty terms. Information about warranty service is provided by phone: (8~5) 278 5456.
  • The Buyer understands that the Goods in the online store may not fully correspond in terms of actual size, shape and colour of the Goods or other parameters due to the characteristics of the monitor used by the Buyer, and therefore the Seller is not liable for the mismatch.
  • The warranty on the quality of the product is determined by the Seller in accordance with the manufacturer's obligations and general legislation.

Return of Goods – the Buyer's Right

  • If the Buyer did not like the Goods, he may replace them within 14 days from the date of purchase.
  • The Buyer has the right to return to the Seller a good quality, unpackaged, unaltered Goods of merchantable appearance and unchanged properties, if the term of use has not expired or near the end. All purchasing documents for the Goods must be submitted upon the return.
  • Upon returning the Goods on the aforementioned basis, the Buyer also pays to the Seller a charge of 6 € (incl. VAT) for the processing of the return of each unit, on the basis of the invoice provided by the Seller.
  • The Goods if their use and/or consumption cannot be determined, are not accepted and not replaced (e.g.: ballpoint pens, glue, ink, air fresheners, etc.).
  • The Goods of good quality delivered and sold for special orders are also not accepted and non-refundable.
  • If the Buyer is a natural person, the Buyer has the right to submit written complaints to the Seller regarding violation of his rights and/or legitimate interests. If the Seller has, in whole or in part, failed to meet the Buyer's requirements indicated in the Buyer's claim, the Buyer has the right to contact the State Consumer Rights Protection Authority: State Consumer Rights Protection Authority, Legal person’s code: 188770044 Vilniaus g. 25, 01402 Vilnius http://www.vvtat.lt/.
  • If the Buyer is a legal entity, the Buyer has the right to make claims concerning the defective Goods within 5 (five) days from the day the Goods are transferred to the Buyer.
  • If during the warranty period it becomes apparent that the Goods do not meet the quality requirements, the defects are not caused by improper storage, storage, wrong exposure or use of the Goods, and the Buyer has notified of such defects to the Seller as soon as he becomes aware of them, the Seller, at his own discretion or remedy, shall correct the defects or, if not possible, shall replace the defective item with another item. Warranty repairs are carried out at Seller's premises. The item for warranty repair is provided by the Buyer.
  • The Buyer must contact the Officeday Warranty Service Department for warranty repairs at the following address: Ukmergės g. 250, 06120 Vilnius, tel. (8 ~ 5) 278 5456 and complete the submitted transfer order of Goods.

Responsibility

  • The Buyer is fully responsible for the registration information contained in the www.officeday.lt online store. If the Buyer fails to submit accurate data in the registration form, the Seller is not liable for the consequences.
  • The Buyer is responsible for his actions when using this online store.
  • The Buyer is responsible for transferring his login data to third parties. If the services provided by www.officeday.lt are used by a third party, the Seller considers that the person accessing the online store using the Customer's login data is the Buyer.
  • The Seller is exempted from any liability in cases where the loss arises from the fact that the Buyer, despite the Seller's recommendations and obligations, did not understand these Rules, although he was offered with such an opportunity.
  • If the Seller's Online Store has links to websites of other companies, institutions, organizations or individuals, the Seller is not responsible for the information or activities contained therein, he does not supervise nor control these websites and does not represent these companies and individuals.

Exchange of information

  • The Seller shall send all messages to the e-mail address provided by the Buyer in the registration form.
  • The Buyer sends all messages and questions to the address indicated by the Seller in the Contacts section of the online store.

Final provisions

  • These rules were drawn up in accordance with the legal acts of the Republic of Lithuania.
  • Relationships arising from these rules are governed by the law of the Republic of Lithuania.
  • If the Buyer does not agree with these rules, he cannot use the services of the online store www.officeday.lt.
